from what I read the 4th is solely contingent on the B's re-signing him after the draft. So, it potentially could be 2nd AND a 4th.
but it will probably just be a 3rd.

It still bothers me that the NHL hands down a punishment, then just undoes it because it's "the right thing to do". Are they going to be so forgiving toward teams that get slammed with the cap recapture penalty? - BulliesPhan87
so did this come as a result of an appeal filed by the Devils or is the league just saying (frank) it and doing it for no reason? |

The Kovalchuk deal that was struck down by the league. They extended a second offer shortly thereafter which ended up being "fair" in the eyes of the league, but that first one warranted the punishment. |

They signed Kovalchuk to some stupid long deal (like 15 years) with some serious back-diving money, to which the NHL basically said enough is enough and hit them with some penalties. This led to the rule about salary change from year-to-year of a contract (like how the Flyers had to rework Talbot's). |
