I think its safe to say that this season has been a major disappointment. To be honest, my enthusiasm for the rest of this year is less then stellar. With that said, I think the off season has the potential to be exiting. We will see what will happen with Kesler and/or Edler. We have the draft, free agency and chance to see if any of the prospects are ready to make the jump.

Getting good returns for Kesler and/or Edler will be very crucial for the next few years. And yes, getting a high pick this year can't hurt. I'm not pumped about finishing 9th or 10th in the West. |

I don't think we will. This team is going down hard. I'm all for #tanknation this year, but I hope there are some changes this summer and we have a good bounce back next season.
edit: even though the the twins are on the decline, You have to think that them and Burrows can have a better year next year then this year. That alone will help. |

Am I missing something? I thought the Devils just got their 1st rounder back (last pick in the round/nontransferable) & reduced fines for conscious circumvention of the cap... What does it have to do with recapture? |

The NHL rescinded the penalty for conscious circumvention of the cap. The recapture penalty is also a penalty for conscious circumvention of the cap. If it ever came down to a recapture penalty, a good lawyer for the Canucks would have a pretty strong case against the NHL to have that recapture penalty rescinded (or reduced) citing the NJ/Kovalchuck decision.
It might not be a slam dunk, but it definitely give the Canucks some wiggle room if it came down to it. |

Giving them a first round draft pick back this year speaks volumes here. The fact that Lou never gave one up over the 4 year window he was supposed to (especially when they could have given up the 29th pick in 2012) makes a lot of people think that Lou knew if he fought it long enough he would never have to. |

Yes, but the NHL gave the pick back showing that the penalty can be adjusted. A good lawyer has something to sink their teeth into. It could very easy turn into a class action suit with Chicago (Hossa) and Detroit (Zetterburg) getting involved as well. |

Generally these things get grandfathered in but if the owners signed off on the introduction of the recapture penalty in the new CBA that would be applied retroactively covering all existing contracts then it would be tough to dispute it in court. |

Exactly, all any good lawyer needs is a thread to start pulling on to unravel everything. The BIGGEST precedent set by the league today was that they will alter the punishments for trying to circumvent the cap. Now that they have done that, all bets are off. |

I'm confused by your argument. The Devils were penalized up front as Kovalchuk's contract was deemed to have circumvented the cap. That was later reduced.
The Canucks have never been penalized for Luongo's contract as it wasn't deemed to have circumvented the cap.
What we are talking about here is the possibility of a recapture penalty if Luongo retires early. That's a different clause all together. |
