Exactly - and as it is now if Luongo retired there would be recapture penalties. None of you know whether or not a lawyer could take this Kovalchuk situation to court and use it for precedent.

Once NJ paid the recapture penalty the precedent was set, I don't think any team will get out of the recapture penalties.

There are 36 of these contracts, 37 if you count Kovalchuk.

No - they didn't. I guess what the guys are saying is, if part of it can change, regardless of what part. There's a president for any part to change.

Although, I'm not sure the the draft forfeit and fine are part of the CBA?

First of all, no legal precedent was set, period. This was an NHL decision to lessen a penalty that was only enforced on one franchise. As of today, recapture hasn't been challenged or beaten by any team & the fact that the Devils willingly paid it this season sets the only truly relative precedent regarding recapture thus far.

So what's the worst case scenario for this season?

IMO:

1) The Canucks gather just enough points to make the playoffs
2) Get swept
3) MG states after game 4: "It was a strange year with all the injuries but I believe the fight we showed down the stretch and what we saw with a healthy squad in December is far more indicative of the team we really have. I like the core we've got."

You're right, legal precedent wasn't set. My point was NJ put a crack in the wall. I'm not saying the Canucks will get out of recapture but based on today's decision it opens the door to that possibility.

You didn't read what I wrote did you? I never said a legal president was set, only that one could argue it could be challenged. Anything can be challenged from a legal standpoint, regardless it's a moot point, until it happens it's not really a bother.
