Why people actually give a (frank) about muslims wearing niqabs in Canadian citizen swear in ceremonies

t’s time to put the niqab issue into perspective. The misplaced rhetoric is getting out of hand.

Late last week Calgary Mayor Naheed Nenshi said on a radio program: “This is unbelievably dangerous stuff.”

Only he wasn’t referring to the wearing of the niqab itself – a full face veil certain Muslim women choose to wear.

No, instead he was referring to the Conservative government’s continuing court saga to defend its 2011 ban on wearing new citizens wearing face coverings while delivering the citizenship oath.

Nenshi continued that “this is disgusting and it is time for us to say stop it — it’s time for us to say this is enough.”

A few important issues need to be clarified here.

First of all, the only thing currently being contested is wearing face veils during the oath. It’s not a ban against wearing them out and about in public, like the one that was implemented in France in 2010.

Nor is it a ban on wearing overtly religious attire in all government buildings, such as was proposed by the Quebec Charter of Values.

No, it just says that for that brief time when reciting the citizenship oath you need to show your face. Isn’t it reasonable to want to see someone’s face during this time?

It’s also important to understand just how much this is supported by regular Canadians. A taxpayer-funded poll ordered by the government and released several weeks ago showed 82% of Canadians support the ban. A CBC “vote compass” poll found only 19% of Canadians were OK with keeping the veil on during the oath.

This brief and one-time pause on the wearing of the niqab is small beans compared to similar legislation around the world.

While the Taliban made it against the law to not wear the niqab in Afghanistan, countries such as Turkey, Tunisia and Syria have had niqab bans in certain public spaces.

Even here in Canada there’s appetite for much more – like the majority support Quebecers showed for their pending Charter of Values or how the Muslim Canadian Congress has called for a total ban on niqabs and burkas.

It’s also integral to keep in mind whenever a critic of this law wants to toss about phrases like racism (Islam is not a race) or the non-sensical term “Islamophobia,” that the wearing of the niab is far from a pan-Muslim issue. Shia and Ismaili Muslims, among others, don’t do it. It’s generally only certain Sunnis, like the extremist Salafists, who actually care.

Then there’s the ultimate kicker: Nobody needs to wear a niqab. It’s a choice. Like how all religious observance is a choice. So-called religious discrimination just isn’t equal to discrimination based on gender, race, ability, etc. The latter is about the way you’re born. The former is about the choices you make. It’s wrong to judge people for what they are, but fine to judge them for their choices.

Granted, that doesn’t mean it’s right for the government to dictate what choices we make. But they’re not. All the ban says is that in this one instance your civic duties have to come before your religious duties.

On the subject of accommodation, it’s not unreasonable to expect the niqab wearer to be the one to do the accommodating.

If anything’s “disgusting” here, it’s that the likes of Calgary Major Naheed Nenshi want to make this relatively minor law that is supported by a majority of Canadians into a bigger deal than it really is.
