I agree with you for the most part on this, however what if this truly was an isolated incident? You are speaking as if she is mentally imprisoned by his abusiveness, which is entirely possible. Or this literally was an isolated incident and she was able to forgive him.

Either way he is a criminal and should be in jail. I just wouldn't go as far as to say she's incapable of making the right decision based on what he's done.
