Just say Vinny retires tomorrow -- bear with me, let me finish -- but just say that's what he does. Then he wants to play next season.

He has to apply for reinstatement if he retires with time left on his contract, right? Not that it wouldn't necessarily be granted, but it doesn't necessarily have to be, right?

If he filed retirement papers, he'd need approval for all 30 teams to be reinstated. If he didn't file papers, he's technically not retired and the contract remains in effect.

I believe that upon submission of the papers the SPC is terminated.

Apparently, to some posters there's a difference between this statement

"...just he and the team need to agree to a termination, after he passes unconditional waivers-or in Vinny's case he could refuse the waivers."

and

Exhibit 1 clearly spells out the conditions under which an SPC can be terminated. Either by a buyout, or by mutual termination

There are conditions upon which a mutual termination would be granted by the League. Detailed in Exhibit 1.

Exactly. I don't know of any specific clause that kicks in for this situation, but there's plenty of language dealing with arbitration in the CBA.

Maybe we'll see if Kovalchuk does decide for on last kick at the NHL can if the KHL oil barons can't afford to pay him with the oil price dropping

Obviously the NHL would have to approve, because they have to approve all transactions, be it a free agent signing or retirement or trade.

That's the gray area. If both Vinny & the Flyers want to terminate the deal, and there is some need to have a violation of the SPC, it can be easily created.

Get caught artificially creating a violation of an SPC, and the team is facing fines of up to 5M and forfeiture of draft picks, and the player is facing a fine of up to 1M.

None. Vinny leaving the team and refusing to practice or skate with the team is a violation of his SPC, and therefore, probably valid grounds for the termination of said contract.

If he'd be willing to leave $8.5mm on the table, which is highly doubtful, he's probably willing to leave the team to trigger the process of a termination.

It would be grounds to terminate the contract. However, if the Flyers and Lecavalier got together and conspired this as a ruse to get out of the contract, and the League found out about it, then there would be an issue.

Pure hypothetical. I'm sure that if Vinny went to his agent and said I want out now, I don't care, his agent could advise him on what steps need to be taken. At some point, both sides would have to communicate a desire to resolve the impasse, via contract termination or buyout.

That said, no matter how embarrassed or hurt he is, I doubt he's willing to be painted as a malcontent and walk away from $8.5mm guaranteed(actually $10.5mm counting his signing bonus due July 1st), because I don't see another NHL team willing to give him anywhere near that, or longer than a one year "show me" contract.

His decline in play is enough to scare teams off, if he's abandoning a team, it might be the end of his career. Might as well be the good solider and hang on for a buy out or potential trade.

I can honestly say that while I was a little too young to track Gretzky's numbers with that kind of detail, that's one of the most amazing stats I've seen in years. Yeah, plus-minus is flawed, but DAMN
