Since McLellan had a year remaining on his contract with the Sharks, and since the Oilers will be bringing him into the fold during the offseason, San Jose is eligible to receive a third round selection in one of the next three entry drafts of Edmonton's choosing. Draft pick compensation for teams who see coaches, GMs or other executives hired away from them hasn't been enforced in the NHL since 2006 but an agreement earlier this year brought it back into implementation. - Dozzer
Many teams have opted out of receiving the pick. There are other reasons why they may not take the pick. Its been speculated SJ may take it. Boston on the other hand may opt out of taking the pick for Chiarelli. Detroit made it clear before even allowing him to talk they wanted the pick.

So the Sharks brass might bring up the topic of a free 3rd round pick from the Oilers simply by asking for it and they'll decide "naaaawwwwwwww". - 1979AD
There are other reasons why they might decide not to take it. For instance getting out of remaining contract without penalty.
