My guess is, that the police see that there is chance that this thing goes away, that's why they've not officially charged him until they talk to him. Most Rape charges are sketchy. I think more than 50% turn out to be bogus. I think most complainants think they can just throw the "R" word out the guys just gets hauled away for life instantly. I'm talking about criminal procedure and what we can read between the lines if we know what the procedure is.
If I recall correctly that (i) the authorities need a warrant before they can bring you in (it's always an "arrest," technically, but sometimes you're only wanted as a "material witness"), and (ii) the authorities need to demonstrate "probable cause" to a court before they can obtain a warrant; and (iii) we can presume from the use of the phrase that Kane might "turn himself in" that the cops were threatening to bring him in if he didn't do so;
Then can't we presume that a necessary predicate for all of that was that the authorities had demonstrated to some court that there was probable cause to arrest Kane, whether as a witness or the subject of the investigation. BTW "probable cause" is a much lower standard than "beyond a shadow of doubt" which is necessary for a conviction.
And I am not a criminal lawyer. |

This is really confusing to me, from a very technical legal sense.
Graham confirms that Kane is only being INVESTIGATED, not charged. And in his next tweet, he says Kane may TURN HIMSELF IN.
I don't believe there is any need to turn yourself in unless your wanted, or, in a legal sense, a warrant has been issued - which requires "probable cause." We're starting to slide down a fairly slippery slope here. - Der Kaiser
probably just trying to get out in front of this. cambria represented him last time, everything from this point forward will be geared towards getting him cleared. regardless of what he did, he put himself in a bad position again. i think if i was young and rich i would live locked away in my house like howard hughes. |
