Much of this is actually inaccurate. A suspension by the League would have no impact on any potential criminal case. The League has the right to suspend when there is a criminal investigation underway where not doing so undermines the interests of the league, i.e. where it might make them look bad if he turns out to be guilty. This is what they did with Voynov and it didn't affect his case in any way.
I'm not even sure what rights of appeal he has n this kind of suspension. If not playing hockey would depress him too much to fight the legal issues he has bigger issues than anyone thought. - Canada Cup
Big difference between "could" and "should." i've been arguing about the latter. Yes Article 18-A grants the Commissioner extensive rights to suspend for off-ice conduct. But SHOULD he do that before any charges have been brought? Should he do that if he can't yet prove what happened at Kane's house? There is a HUGE gap in severity between Kane's case and the misconduct alleged in deflategate, and so should the severity of embarrassment be increased a thousand-fold for the NHL getting too far out in front of this very serious matter. At least with Goodell, he felt like there was no other means of punishing these offenses if he didnt act. Here the team/league should refrain from acting until the criminal process is resolved. Otherwise they will have a circus on top of a circus as Kane has no choice but to fight on multiple fronts.
BTW, there are extensive formal hearing and appeal rights re such suspensions, and a separate clause (Sec 18-A.5) for delaying the Commissioner's discipline if it overlaps with ongoing criminal and/or civil litigation (no doubt for the reasons I prev described). such relief should be granted unless Bettman proves "substantial risk of material harm to the legitimate interests and/or reputation of the League." Star witness = David Sterne and Kobe, whose team went to the nba finals with high ratings the year he played with rape charges hanging over his head. I promise this is my last post on the legal framework here, cause I know its boring. And maybe Kane will be a good little boy and just take it all with a unicorn smile, and this will all be moot. But don't say no one warned y'all if the Hawks overplay this to get pre-camp cap relief and Showtime responds as Showtime does -- to win. This will get a whole lot uglier.

Still standing by Kaner's side and hoping to hear good news soon. If he needs to sit out for a while to get his personal life together, so be it. I support him in doing that. As long as he comes back when he's ready, remains a Hawk and gets back on the ice asap doing what he does best, leading us to more Cups.

The NHL hasn't done anything yet, neither has the Blackhawks.
The comparison to deflate-gate needs to stop. The embarrassment for the league would come when police show up at a game and pull Kane off the ice to cuff and arrest him for rape. No, I don't think that would happen but that's the potential impact. What's the downside of him staying away until it's settled? Not much.a few months of him not playing. We'll all survive.

There is no comparison between deflategate and Kane...None.
Ultimately the ball incident happened becasue the NFL didn't not have the proper protocol in place...But the last thing they will do is blame themselves.
That was why it was misguided to suspend Brady for so long when the same stuff has been going on for years. |

Toews said nothing surprising...or particularly news worthy.
Jon and all his mates will repeatedly make the same public statements when camp opens, and nothing will change until the incident is officially resolved.
Edit...now it would be interesting to hear what the players say in private, but I doubt we ever will. |

Since we now have three Russian players on the Hawks roster there is a good chance another Russian player might be added next year. Maxim Shalunov our draft pick from 4 years ago is starting to make some noise in the KLH. His game really picked up during the KHL playoffs last year. Maxim , in the first 5 games this year has three goals and two assists. He is on his last year on his contract for Sibir. I always liked the kid when he played at Rockford. He might be a late bloomer. His defense has improved quit a bit. Fast skater and has a very accurate hard shot. He gained about 20 lbs and is 6'3". |
