I don't think that rule is applicable in this situation since the player assumed his position for a good 3-4 seconds prior to being hit. That means gudas had time.
That rule I believe is applicable when a player for example turns his back to hit last second and flies head first into the boards

Nahh, honestly I get some of the frustration. If that was Giroux being hit we would be annoyed.
Personally I just like that the team actually has a guy that can bring a punishing brand of hockey consistently. So tired of seeing them being pushed around, and play emotionless for the last few years. Could he be smarter? Sure.

Time has nothing to do with subsection (ii). You are getting it confused with subsection (iii). Read the actual rules, instead of coming up with your own.
48.1 Illegal Check to the Head – A hit resulting in contact with an
opponent’s head where the head was the main point of contact and
such contact to the head was avoidable is not permitted.
In determining whether contact with an opponent's head was
avoidable, the circumstances of the hit including the following shall be
considered:
(i) Whether the player attempted to hit squarely through the
opponent’s body and the head was not "picked" as a result of poor
timing, poor angle of approach, or unnecessary extension of the
body upward or outward.
(ii) Whether the opponent put himself in a vulnerable position by
assuming a posture that made head contact on an otherwise full
body check unavoidable.
(iii) Whether the opponent materially changed the position of his body
or head immediately prior to or simultaneously with the hit in a way
that significantly contributed to the head contact.
Kronwall is as predatory as they come, especially in playoff time.
Hate to play against him, but would love to have him. Gudas is a turd in the talent department when compared to Kronwall but on a 3rd pair for a stanley cup run? Radko is a good piece.

So if guys skate around and squat when a guy is coming their way, should it be a penalty on the hitter? Hell, Ovechkin had a much dirtier hit on Simmonds last week when Simmonds was on his knees and no penalty was called. He hip checked simmonds head into the side wall.
The guy reached down. Thats his fault. If there is ANY area on the ice that you shouldnt do that... its right there. Now if he had fallen over... different story. He put himself in a bad spot.
