There are only three ways for him to return:
1. All thirty teams would grant permission to return to the NHL. He would be a free agent.
2. Kovalchuk can sit out a year and not play hockey anywhere. After then, only the Devils need to grant his permission to return to the NHL. He would be a free agent.
3. Kovalchuk would wait until he's 35. At that point, he's free to come back without any permission. That would be the 2018-19 season, or two years after the speculated season he's considering leaving the KHL. - jmatchett383

The devils were to forfeit $3 mill, a 3rd and a 1st. After Kovalchuk went to the KHL they got some of the money back and never had to forfeit the 1st round pick.
Kovalchuk did the Devils a huge favor by leaving.
1. The Devils had Kovalchuk for the most productive (early years) of the contract.
2. Kovalchuk's contract was somewhat backloaded so the Devils paid Kovalchuk the cheaper years of his contract. The year he bailed his contract was slated to go from 6 mill/yr to 11 mill/yr.
3. Rumors were that the Devils couldn't afford to pay him the 11 mill as they were swimming in debt at the time. They might still be.
4. Kovalchuk's retiriing was a lot more palatable than a buyout would've been during any part of his 15 year contract both in terms of money and cap recapture.

This was a clear case of cap circumvention allowed by the league. They made up some penalties which were much easier for the Devils to handle.
The LA Mike Richards fiasco was another one. Utter BS how Lombardi made out there.
I would even say Chicago pulled one off last season keeping Kane on IR which gave them the space to sign Vermette and win another Cup. Season ends Kane comes back for the playoffs when there is no salary cap concerns and Vermettehelps them win a Cup. Not saying Kane wasn't recovering from surgery, but the timing of his return allowed them to bring on Vermette.
