I don't think it would be too complicated for Kovalchuck to come back contract wise. He could simply just retire from the KHL.
Edit: What I get from Daly's statement is because Kovalchuck hasn't missed a full year of hockey he remains Devils property but can only play if all 30 teams allow it. If he skips a year then he can come back with the Devils consent at which point I'm pretty sure he has to clear waivers and if he did he would then become a free agent. |

Another note worth mentioning is that his previous contract was mutually terminated at the time of his retirement so if he were to come back he would have to sign a brand new contract with which ever team he were to end up with. |

Because his hip surgery has been delayed the Oil might not be able to buy him out this summer because he won't be considered healthy. |
