i think the issue is that term is from the nhl by-laws and not the cba.

based on friedman's take, the nhlpa has probably given the nhl and its bylaws a big FU on this one.

i assume the nhlpa's position is because this wasn't addressed in the cba previously, the nhl and nhlpa should come to an agreement for how kovalchuk (and future players) should return to the nhl.
