No kidding, and he only opted for surgery after the Leafs informed him they were going to buy him out. Which was a sign that he thinks his NHL career is over - which it probably is.

I may have blue and white blinders on, but a guy who is healthy enough and cleared to return last year but gets shut down by his team (and paid in full) to avoid injury for precisely the reason of a buy-out, yet goes and gets surgery on his own in the offseason without consulting his employer and then challenges said buyout???
I get it from Cowen's perspective as to the "why", but it seems like a pretty straight forward case for the arbitrator. You were healthy last year when we shut you down...you should still be healthy.
Seems to me Lou would have something in his back pocket to get around a ruling in Cowen's favour. I bet he is suspended for getting the surgery without team consent - has to be a provision in his contract - similar to the "no waterskiing/no snowmobiling/no parachuting/etc." provisions in a contract. |

precisely... if he was instructed not to have further medical treatment then its bad on Cowen... if he was deemed healthy by the Leafs medical personnel, then he (Cowen) chose to have the surgery expressly to get around the buyout.

You are probably right - in any event - he has torpedoed his career with his move. Maybe LV takes a chance on him - if they want a big, really slow (and poorly conditioned) high pick that never amounted to much.

If we buy him out, we end up with a caphit next year.
If we don’t buy him out and use on LTIR on him/other players, we’re very likely to have bonus overage penalties for next year.
The extra contract spot for this year could be useful.
But I’m not losing sleep about it either way. |

I know they can't use this...but they should be able to in the hearing and that is that Cowen's ability does not warrant even close to 4 million dollars this season. He isnt an NHL caliber player anymore. |

I don't know about you guys, but there is no way I sign any contract for any $ with any terms/language dictating how and when/when not to receive medical treatment for anything involving my personal well being.
