If I was a professional hockey player I wouldn't not have the surgery I needed just because a Leaf GP said so. - the_eye
From nhl standard player contract:
Should the Player be disabled or unable to perform his duties under this SPC he shall submit himself for medical examination and treatment by a physician selected by the Club,
It goes on to say:
In the event that the Player wishes to seek a second opinion in respect of the Club Physician's determination regarding the Player's fitness or unfitness to play, the Player shall provide electronic notice to the Club
There is bunch of crap if the club and player’s physician don’t agree.
Seems to be enough grey area and enough money on the line that it’s worth it for cowen to pursue. My guess is the leafs are in good standing to win the grievance.

I think that you're severely underestimating just how (frank)ing terrifying Lou is... |

If he was cleared to play and healthy, they why did the leafs refuse to play him? because they didn't want to risk aggravating the existing injury. doesn't sound like a healthy athlete to me and sounds a bit dodgy to me. - vermie22
Risk Mangement.
Because they told him - and the media - they planned on buying him out and they couldn't do that until end of season and didn't want to risk him ending the season injured and therefore inelligible to buy out...simple |

you seriously don't see a potential conflict of interest there? - vermie22
No more than I see a player wanting to keep $3M in salary he doesn't have the collectively bargained right to.
Jared Cowen isn't bound by professional ethics standards as a hockey player - physicians are. |

You can tell it's July 28th up in this female dog when people are arguing over buyouts and the medical rights of a player/team with regards to Cowen of all (frank)ing people |

and he took the same risk management steps to insure his health and financial well being. simple. the only question is whether or not he notified the leafs that he was getting the treatment. if he told them he was doing it, they have nothing. |

I work with contracts for a living so with the right Adobe SW and a little know-how it's a lot easier than you'd think.
It's amazing how stubborn people can be when a little bot of fact gets in the way of their feelings/arguments.

Right, how convenient...... What 4month he waited to "get it done early". How is that early? |

He should be thankful that he's no longer on a team that'd pay him out in trident gum and "IOU" notes and just take the (frank)ing buyout... |

Becuase he sucks?
Becuase he may get injured in some other way (not related to current injury)?

If the Club Physician and the Player's Physician cannot agree on whether the Player is disabled and unable to perform his duties as a hockey Player they shall confer and agree on an independent physician to examine the Player. |

I'm we'll aware of what poa is and how it works.
No one is saying the team has poa, only that they have a right to be informed. No one is saying they control the decision. |

Do you think the leafs (knowing you can't buy out injured players, and the length they went to to keep him from getting injured) would try to buy him out if they knew he had had surgery? |
