This part is pretty interesting:

Wouldn't be surprising to me that GMs start to use this little loophole to get around the NTCs they give out. Not that I blame them, if the player is that set on making sure they don't end up in certain places, then they need to make sure they're proactive and have their lists in in time. - HonkFortheGoose

He will be placed on unconditional waivers and once unclaimed, sabres will begin process of terminating the contract
If the Berglund camp fights it, and its a losing battle for them, it will delay things where Berglund will not be playing this season and if they don't fight it he will be playing in Europe within a few weeks |

Violating Terms of the CBA
According to the NHL’s Collective Bargaining Agreement, the conditions for which a club can terminate a player’s contract are pretty simple: “The club may terminate the standard player contract if the player should fail, refuse, or neglect to obey the Club’s rules governing training and conduct of players, if such failure, refusal, or neglect should constitute a material breach of this standard player contract.
Right now, Berglund is considered in breach of his contract – he missed an event that he was supposed to attend. The Sabres have the right to void the remainder of his deal without any ramifications on the salary cap. It could become a case similar to that of Jake Dotchin and the Tampa Bay Lightning; another battle between the league and the players’ union.

This guy skips a word in the contract language that makes all the difference in the world.
Berglund is, in fact, in breach of his contract. But the Sabres DO NOT have a clear cut right to terminate the contract even after the clear cut breach (and even if it is proven that Berglund was "out partying with Swedish guys instead of being sick").
The Sabres have the right to terminate the contract if Berglund is in "MATERIAL breach" of the contract. So far, he has only missed a week of club related activity. The contract is a 5 year contract - missing a week of work over five years might not be a MATERIAL breach of the entire five year contract.
Of course, a professional athlete quitting on his teammates is a disaster, so there is a really strong argument that there has been a material breach. But this kind of uncertainty is exactly the sort of thing that results in legal settlements.

Update on Berglund
Update (12/17/18)
I’ve spent the last 24 hours doing some homework on the situation with Patrik Berglund and the Sabres after talking with a few connections around the league.
Here are some updates on the situation.
As we know this no-trade list thing is a big part of this but regardless of that Berglund showed up in Buffalo after the trade was made.
He fit in well initially and the other Swedes on the roster gravitated to him as a leader.
Hence, Jack Eichel’s “Swedish Godfather” comments in training camp.
After the scratching against the San Jose Sharks and another healthy scratch later in the season he started to become displeased about his diminishing role and overall usage.
The Sabres were aware of his frustrations, but were caught off guard by his decision to not show up for the flight to D.C. on Friday.
For now, all sides are working towards a solution how to move forward. As mentioned in the initial article above the option of terminating the contract is on the table. As well as the option for Berglund to return to the Sabres and continue playing.
Also, from what I’ve been able to gather any rumors on partying being an issue with Berglund appear to be untrue.

Disagree. The SPC contains a clear requirement that the player arrive to camp "in good physical condition." That is a much more definable standard than whether one week in five years is a "material breach."

He signed a contract that says he'll show up to games. For five years. He didn't. In fact, he lied about being sick for 2 of them and then just flat out didn't show up for a 3rd.
I think the Sabres are showing good faith by trying to talk to him to resolve this, but really, at the end of the day, I don't know how Berglund walks back into that locker room. I'm sure he's lost the respect of all his teammates at this point. He quit on them, and I just don't suspect that this group isn't going to just pretend like there isn't an elephant in the room. |
