Berglund, while with the Blues, had a full no-trade clause until June 30, 2018. As of July 1, when the trade happened, it became a partial no-trade clause. His updated list of teams was not received in time and therefore the trade was legal and binding.

It really seems shady on Doug Armstrong's part. How much time did he really give to get the 20 team list? A lot of people questioned Berglund's contract when it was first signed, and many here and elsewhere called it a cap dump. I would think that if he wasn't willing to come here they could have contested the trade at the time it was made. |

You have to imagine a lawyer or his agent let him know what the consequences would be if he simply didn't show. He could have simply stayed with the "I'm sick" excuse and stretched this out a while.
The more I think about it, the more I think you're completely right. The Sabres should play nice until Friday then bring in every legal mind they can to answer the simple question: how do we axe this contract and keep it off the books? |

The team gave him the NTC. The fact that he/his agent didn't submit their list to the league is on them, not on the team.
That's the interesting part there. If the player doesn't submit their list, that's not the teams fault.
I guess in good faith the team could call and say "Hey, is there a reason you didn't submit your list?" but at the same time, that indicates to the player that a trade is imminent and adds a whole new dimension of ugliness. Especially if at the end of the day the player DOESN'T get traded. It's fairly messy either way. - HonkFortheGoose

Last year the biggest Liiga contract was approximately $440k USD and I could only find the highest SHL contract from two years ago which was approximately $250k. He would be essentially giving up an entire team's payroll by having his contract terminated. |

Unless he is MIA because he is in rehab, he really doesn't have a leg to stand on.
Material breach of contract: In contract law, a "material" breach of contract is a breach (a failure to perform the contract) that strikes so deeply at the heart of the contract that it renders the agreement "irreparably broken" and defeats the purpose of making the contract in the first place.
The purpose of the contract given to him is to play hockey, he has not done that without given a reason, he has simply not shown up.
The Sabres hold all the cards.
Like you said, he isn't on unconditional waivers yet, but if he doesn't report by the weekend, he is a goner.
The Sabres are actually showing good faith by only suspending him for the time being.

The point here is that it's not his responsibility to do it. It's the players responsibility to take care of the items like a list of what teams they don't want to play for and submit it to the league. My guess is he should have had it submitted to the league prior to the July 1st date that it kicked in so that if something came down, he was covered.
He didn't do that. Or his agent. In any event, if being able to pick where he could possibly get traded to was such a big deal to him, he should have made sure it was taken care of.
This is like bouncing your bank account. It's not the banks responsibility to call you and remind you you have an autopay for your cellphone account coming out in 2 days and you don't have enough to cover it. They don't do that. As an adult, it's your responsibility to ensure these types of details. It's no different. |

I'm hopeful that your crystal ball is working today on the Bergy situation. It would be a home-run for Botts/Sabres if they could unload him now without costing a player or $$. Freeing up $4 million annually over the next 3 1/2 years would be huge.
Also, with each passing game I appreciate more and more what Sobotka brings to the team from a defensive perspective. He wins key draws and kills penalties really well. The only negative is when Housley sticks him on the ice in O/T instead of Skinner. Not sure about that strategy.

This is a line that Drouin crossed, under different circumstances. Under that scenario, the relationship was already damaged and he didn't want to hurt his chances of being traded to a team after being demoted, so he just didn't play. By terminating Drouin's contract, the Lightning would lose a significantly valuable player with a premium contract.
Berglund has no real value, and his contract vastly outweighs his usefulness. With his inflated contract and term, coupled with his declining abilities and speed, along with simply choosing not to show up AND potentially lying to the team, the team will be lucky to recoup a useful AHL guy or a mid to late pick. Termination seems like the nuclear option, even though its the most obvious. The organization likely feels the need to do it's due diligence to satisfy a player that has wronged them to at least get some value for him in return. This also paints the org in a better light, as it helps all it's players, regardless of stature.
A legal battle with the NHLPA will ensue if the path of contract termination goes forward. All facts must be gathered and the team must prove no fault.
Mike Richards blew coke and crossed the border with it and the Kings still needed to pay him, and keep his awesome salary on their books for another two years. |

I agree that the onus is on the player/ agent to get the list submitted, however I do not recall a time that this has happened before. On the other hand, I have heard countless times when a team has asked a player for their list prior to being traded. I think a big part of this trade was the timing with ROR's bonus about to kick in at the end of the day. |

On the other hand, I have heard countless times when a team has asked a player for their list prior to being traded. I think a big part of this trade was the timing with ROR's bonus about to kick in at the end of the day. - adambuffalo
I'm sure you don't hear about it often because
A) The team will likely try to honor the list even if it's late
B) Trades are probably not pulled off immediately after lists are due
C) Most players don't cause a stink after going to their new teams
When you think about it, it's an extremely rare scenario. |
