The recapture penalty is 2 years. Termination penalty is 8.

sabres can A. take him back which is really less then 1 percent of that happening
B. allow his agent to work out a trade, again less then 1 percent of that happening
C. unconditional waivers, which he will clear, and then begin the process to void the contract. The Sabres have all the rights to void the contract now, and all the Berglund camp will be able to do is either try to contest the losing battle or recapture most of that money in an overseas contract that will get him paid in Jan.
Pretty sure the camp would rather be paid 80 cents on the dollar starting in Jan rather then fight a losing battle and lose who knows how much money.
You make a dumb mistake, and you have the chance to get 80 percent back right away or roll the dice and most likely get next to nothing for a year which would you do?
I still think this was a calculated plan by Berglund and his agent to get Berglund out of Buffalo and overseas |

Plus, Richards remaining contract was for a considerably higher amount (as in pretty close to double what Berglund's remaining amount is). So even if things do follow suit, you'd be looking at a relatively small amount probably over a 5-6 year period. Not necessarily a bad thing at this point. Honestly, I'd take it over the $3M+ that he's on the books for for 3 more years after this. |

Probably premature, but for discussion purposes, I wonder what that termination penalty could be. Maybe 250K for 4 years? I know the Kings rushed that process, which is probably what (frank)ed them. Botts is a smart guy. If they go for termination, I'd put my money on there being zero cap penalties. |

This is a line that Drouin crossed, under different circumstances. Under that scenario, the relationship was already damaged and he didn't want to hurt his chances of being traded to a team after being demoted, so he just didn't play. By terminating Drouin's contract, the Lightning would lose a significantly valuable player with a premium contract.
Berglund has no real value, and his contract vastly outweighs his usefulness. With his inflated contract and term, coupled with his declining abilities and speed, along with simply choosing not to show up AND potentially lying to the team, the team will be lucky to recoup a useful AHL guy or a mid to late pick. Termination seems like the nuclear option, even though its the most obvious. The organization likely feels the need to do it's due diligence to satisfy a player that has wronged them to at least get some value for him in return. This also paints the org in a better light, as it helps all it's players, regardless of stature.
A legal battle with the NHLPA will ensue if the path of contract termination goes forward. All facts must be gathered and the team must prove no fault.

Honestly, I'm hoping for a clean break with no type of penalty or whatever.
But my guess would be that the NHLPA won't be on board for that. So we may see some sort of cap penalty. Probably a certain percentage spread out over a set number of years similar to the Richards thing. But due to Berglunds contract being for less and shorter than Richards was, I don't suspect it'll be that much. I think Richards ended up like 1/3 or so over twice the remaining term, but I haven't looked at it that closely.
So I'm not sure if we would need to do like 6 years (since he has 3 remaining after this one) or if this one would count to make it over 8 years if you're doubling it. |
