I believe it depends on the state. Some states I know have no laws at all, some are super strict. Here in New York, I can say having bartended for 10 years now, if someone just gets a DWI, no police officer is going back to their bar to investigate.

Essentially there were two kinds of people we had to cut off or not serve:

1) Underagers
2) Absolute drunks that would get sloppy

Give them water, ask to call a cab for them and pay, you mitigate a lot of that liability in any state.

That doesn't mean it's not against the law. A simple DWI, no they won't, not worth their time, but if someone dies? That's a different story, and if someone knew where they were drinking and knew they were over-served, like if they had a BAC of .256 and that was the only place they had been the entire day, that adds to it again.

And anyway, this isn't criminal, it's civil; which has a burden of proof of a "preponderance of evidence" not "beyond a reasonable doubt" of a criminal trial.

It's really less than that .66.

Everyone is told .02 per drink and you metabolize .02 per hour, but that's really not the way it happens.

If he was 240lbs for example, I'd wager he gets around .016 per drink, not .02.

It's still a lot and very dangerous, but I would bet he never broke .50. Keep in mind people have been well above .6 and not died. Depends on the drinker.

It's just a simple equation that generally fits most people. It depends on how big you are which determines how big your liver is which helps filter more more quickly, how much enzyme you naturally have to break down the alcohol, how hydrated you are...
