Nashville didn't write the contract, so it seems a little fair to punish them for "attempted cap circumvention" - especially since it was legal at the time of signing. |

We touched on this last year as well. At first I agreed, and then I got to thinking about it . . . it's not like Nashville didn't get to benefit from the rewards of the backdiving contract for 6 years.
Just because Philly drew up the contract, Nashville benefitted from it. Let's say Weber retires at 36 when his contract drops from $6m to $3m, leaving $6m over 4 years on the table. His actual AAV should have been $10.4m, not $7.85, meaning that Nashville had a $2.54m advantage in cap by having Weber in their line-up. Over 6 years, that's an accumulated $15.2m.
Someone should end up having to pay from benefiting from that competitive advantage, and Philly didn't benefit.
Montreal is also now benefitting similarly.
Now, if he plays until he's 37 (the one $3m year), that AAV advantage changes to $1.87m per year.
Bottom line is that it's too late for Nashville to cry foul now. The right thing to do would have been to talk to the NHL, NHLPA, Weber, and his agent when the back diving ruling was launched, cried foul then, and then looked for an amiable solution that resulted in the contract being voided, and Weber not being declared a UFA as a result. |

thing is, the rule is explicit in the current CBA. Nashville approved the CBA as part of unanimous team approval.

I would find a way to (a) offset it, or (b) reduce it (ie, they were under the cap by 'x', so the advantage was not fully realized).
But the truth is . . if you run a league that has a set of rules that are there for the sole purposes of ensuring even competition, allowing one team to violate those rules that gives them an unfair financial advantage isn't something the league should permit.
As an aside, in a related way - I expect the league is going to try and figure out ways to address the financial might of the Leafs & Rangers and so on to limit the amount of signing bonus percentage, or limit the ability to acquire LTIR, and so on.

The NHL is far from a sovereign nation, and by that I mean that they're more pragmatic than a country who upholds the rule of law to the letter. Bettman is indeed concerned with parity, and is also concerned by non-traditional markets and profits for the owners he represents. He will convince the owners to allow some latitude in this situation, since the rules that are being broken are broken because the CBA was broken before the current CBA came into effect. If it can happen with Kovy, it will happen with Weber. |

Looking at comps ...Muzzin will be 31 next month.
Stralman got 3 x 5.5 at age 32
Hjarmalsson got 2 x 5 at age 31
M. Green got 2 x 5.3 at age 32
Looking at CF I don't see any recent 4+ yr deals for D'men over 30.
