My closing argument, your honor, is that the front-loading clause of the CBA is restrictive of the short term savings that the NHL finds permissible, and therefore is not subject to further punishment such as recapture.
I yield my time back to the thread and will expect my cheque from Ek to be larger than normal due to the amount of lawyer reading I had to endure - WhiteLie
Again, that’s your interpretation, but all it says to me is that those long contracts that previously were not subject to any penalties, we were signed under a different set of rules, are now subject to the current rules, which are that teams can not benefit or circumvent the salary cap by paying a player all the money up front so that they can retire early without penalty: - 1970vintage
So to be clear - you're saying that any player is subject to cap recapture penalties based on the new CBA regardless the length or when it was signed?
I understood it as they were grandfathering out that rule from the previous CBA and the only players left in the NHL subject to that rule are:
Shea Weber MTL* 14 2026 $7.857
Duncan Keith CHI 13 2023 $5.538
Alex Ovechkin WSH 13 2021 $9.538
Zach Parise/Ryan Suter MIN 13 (each) 2025 $7.538 (apiece)
Marian Hossa ARI^ 12 2021 $5.275
Sidney Crosby PIT 12 2025 $8.7
Henrik Zetterberg DET 12 2021 $6.083
Jeff Carter LAK" 11 2022 $5.272
Johan Franzen DET 11 2020 $3.954
Jonathan Quick LAK 10 2023 $5.8
Nicklas Backstrom WSH 10 2020 $6.7
Jordan Staal CAR 10 2023 $6
So now if a player retires or quits and wants out of their contract early, they can simply mutually terminate the contract and no cap recapture penalties apply. For example Patrick Berglund who played 23 games in 2018-19 (2nd of a 5 year deal) and said no thanks I'm done for mental health reasons. Or Burmistrov (1 yr deal) who bailed mid season - I believe his excuse was not enough playing time. Players can get out of their contracts under the new CBA without fulfilling their entire contracts - no penalty.

No either do I, what are your thoughts if Canucks pursued Trocheck and what would be the all in cost... - Makita
I like Trocheck, but I think more attention needs to be paid to the back end especially if they are taking on term in a trade. If I'm going "all-in", I'm hunting for defense

Jonas Brodin could be interesting.
If the Wild would stop winning...

Yes, that is the way I interpret the rules. Any time a team benefits the salary cap by paying up front they are subject to recapture if the player does not fulfill the length of the contract. I Don’t know how to look back at previous years cap friendly page. Did St Louis have a penalty? I believe they were the team that signed him to that deal, and gained about $1m cap vs actual salary. Burmistrov would have no implications as it was a one year deal, so cap hit and salary were equal.
I really think Toffoli is going to be a good addition he showed flashes of chemistry on that line last night, and he's just getting his bearings. He did a couple of good things last night he got a point,(waiting for the first point on a new team can be rough)and he stuck up for Petey.
I like the trade and think it will help going forward.
I feel like the frustration of not scoring after soo many chances in the first caused them to press a bit. I am predicting a win against Boston Saturday 4-2

So Buffalo signed the deal (in 2017 for 5 years) and once it was terminated no penalties were incurred. And I believe its Bcus cap recapture doesn't apply/exist for deals signed since the beginning of the new CBA. So for example if Loui was sent to Utica at some point and he didn't like it. He could simply quit or mutually terminate and the contract is done - no penalty. And this sorta thing can happen for a number of circumstances. Check out Vadim Shipachyovs termination - it's interesting.
BTW do you know of any other teams paying a recapture penalty?
Loui to Dallas!! He likes it there.
To Boston for equal "projects" = crap
He liked it there too....
To Ottawa for Anderson (the goalie) Just in case for the PO's and can get claimed by Seattle.
Package with Stech....I'm ok with that.
I can see him getting claimed by Seattle to get to the cap floor.....but him top 6 as a find him something to do, and hope he doesn't mess up (which he does at times) does not a good game make.

Didn’t St Louis sign Berglund, trade him to Buffalo? He played one full season on that 5 year deal.
I know Kovalchuk had a cap recapture, though it was only $500k or something. Most other teams have found ways around it. Didn’t Shipachyov play only a few games? The only way there would be a penalty is if a player received a compensation greater than their salary cap number. I doubt the NHL would be good with Eriksson walking away and the Canucks having paid $7m more in salary than they had in salary cap.

Whitey covered this in the previous blog: no recapture penalty
Sign Tryamkin to play bottom pairing.
Trade Stetcher for a draft pick.
Keep Dipietro in Utica until we to see how the expansion draft shakes out.
Send LE on an Asian cruise and let NJD deal with Subban. - YeOldTimer

yes they did sorry - he was traded to BufF - he got paid 1st year 3.850$ then until Xmas the next year, then walked away from the remaining 14mil (approx) no penalty.
Kovy recapture was bcus contract was signed before last CBA
Shipachyov signed 2 year 9 mil and collected 2 mil in signing bonus, was scratched until xmas, played 3 games, apparently returned 85,000$ of the SB and then terminated,no penalty.
To me these situations are no different than proposed Loui scenario. It's happened/happening so I see no reason why we couldnt do the same thing - no penalty.
Yeah but Vintsey didnt believe you - still doesnt - Brooks_Light
If there really are no penalties why does anyone care how long they sign Markstrom for? Give him an 8 year deal with max $ in the first 4 and if he wants to retire after 4 years great, if not, he can play in Utica for the other 4.

How would people feel in general about trading Stecher for either a draft pick or Simmonds and bringing Rafferty up for the rest of the year? - NorthNuck
I think you want all hands on deck to make playoffs.
Stecher should be flipped in offseason.
Don’t want to have 2 rookies on D at this time of year.
IMO.

@PierreVLeBrun
Hearing the Canucks tried the last few days on Wayne Simmonds in NJ but couldn’t make it work cap-wise, perhaps because Brock Boeser could return before the end of the regular season. So as of now, the Simmonds option not as likely for Van...

Ryan Graves and Cale Makar seem to be doing ok.
I guess Graves isnt a rookie cause he played 26 games last year, but you get my point.

What would that say to the room about their desire to make the playoffs? I think their feelings would be hurt.
