The one thing missing in some of these arguments is, player's mentality of intent going into a check.
I will say from personal experience, "positioning of my body" when going into a check really was dictated by my intent going into it. If I was just playing the body to take the puck away, then that significantly changes my body position and reduces chances of injury. However, if my intent is to vent anger, go after the guy or i'm just pissed, my body is in a position that will increase potential injury or contact to the head.
So the milliseconds argument is valid in the case of just making a play and poop happens. But I do not buy it when the player's intent is to be aggressive. Your intent created the potential issue in that case. - NYRCeph
Intent isnt exactly easy or possible to prove in most cases, so I think the injury sustained and players history of such infractions should most certainly be factors in assessing suspensions.
From what I heard during the Wilson debacle, the Dept of Player Safety does NOT take history into account when determining I infraction is suspension worthy....is that true? Suspension length is influenced by player history after they determine whether it's suspension worthy....I believe. |

Intent isnt exactly easy or possible to prove in most cases, so I think the injury sustained and players history of such infractions should most certainly be factors in assessing suspensions.
From what I heard during the Wilson debacle, the Dept of Player Safety does NOT take history into account when determining I infraction is suspension worthy....is that true? Suspension length is influenced by player history after they determine whether it's suspension worthy....I believe. - rrentz
It was the amount of time between infractions as to whether or not to take history into account, if I recall from the Wilson Incident. |

I agree 100%. Intent is definitely hard to prove unless you see the guy gunning it at the other player. That's the poop of it. But there are cues to determine how a player is going towards another. Look at Wilson before all that poop before the incident with Panarin.
Also:

"... In deciding on Supplementary Discipline for On-Ice Conduct, the following factors will be taken into account:
(a) The type of conduct involved: conduct in violation of League Playing Rules, and whether the conduct is intentional or reckless, and involves the use of excessive and unnecessary force. Players are responsible for the consequences of their actions.
(b) Injury to the opposing Player(s) involved in the incident.
(c) The status of the offender and, specifically, whether the Player has a history of being subject to Supplementary Discipline for On-Ice Conduct. Players who repeatedly violate League Playing Rules will be more severely punished for each new violation.
(d) The situation of the game in which the incident occurred, for example: late in the game, lopsided score, prior events in the game.
(e) Such other factors as may be appropriate in the circumstances."
Repeat Offender NHL Definition:
A Player is considered a repeat offender for 18 months following his most recent incident that resulted in a suspension. His status as a repeat offender in this category is used to determine the amount of salary forfeited should he receive another suspension.
It is important to note that even if a Player is not defined as a repeat offender, his past history may come into consideration when determining future Supplemental Discipline. |

Based on (d) in the first part something should have happened. He got called, didn't like it, and saw red as soon as he came out of the box with intent to exact revenge.
So, he was clearly within that 18 month window after taking out Carlo.
