I like how you mentioned medical arbitration.
I think the reason this hasn't gone there is because Eichel and his agent know they would lose.

When my wife was a candidate for this surgery (by Dr Cappucino none the less) he was very upfront about the fact that this disc's life cycle wasn't yet known. That eventually it would lead to a fusion.
For her at 28 we thought it made sense to do it since it's not like she is a professional athlete. However after fighting the insurance company for so long to get it done, it wasn't an option at that point so she had to do a fusion. - Stripes77

The doctor who saved Kevin Everett from being paralyzed. The surgeon who is a leader amongst disc replacements and is a huge advocate for them. If he says no there is a reason. |

My favorite part of the statement from the agent: "The process is not working".
Both side agreed upon a contract where your client was compensated for his talent and services handsomely. That contract is being faithfully executed by the Sabres and they are trying to trade your client in an effort to appease him. They believe that is in the best interests of both parties provided they get adequate compensation from the other team. Just because you didn't get what you want, doesn't mean it's not working. There is not a provision in the contract that states Jack has final say in all things.
However, there IS a provision in the contract that allows you to contest the team's choice of treatment and you should use that. If all of that has been done and it hasn't worked out in your clients favor, the process STILL isn't broken because, if you didn't like that you should have negotiated that OUT of the contract PRIOR to signing it.
The process is that Jack is under contract for 5 more years and can exclusively play hockey in the NHL for the Sabres. No one forced him to sign that contract under duress. He did it of his own volition and of sound mind.
The ONLY way this works out for Jack is if he shuts the (frank) up and let's the team work it out. They're not doing ANYTHING wrong if they choose to keep him AND exercise their rights to authorize medical treatment THAT JACK EICHEL AGREED TO.
That's how contracts work folks. Quit being a whiny female dog.
Edit: The org will probably cave if recent history tells us anything, that's why this temper tantrum is happening. But I would LOVE to see KA hold the line.

It's entirely likely that Adams overplayed his hand by insisting the Ducks include Zegras, or the Kings include Byfield, etc.
I'm not saying Adams did anything wrong by trying that tactic, but he may have held the line too long in that regard. |

Dr Cappucino is one of the leading neurosurgeons in the world when it comes to disc replacements. He helped develop the technology and was one of the first surgeons to use them. In fact he has performed more disc replacement surgeries than any other surgeon in the USA .
He is the high end specialist. If he says no, then I wonder why it is Jack is pushing for it so bad. |

He hasn't because he knows he will lose. When the leading disc replacement surgeon in the USA says no, I wonder why that is. |

Because Jack is a hockey player, and hockey players are not necessarily known for their medical expertise.
The neurosurgeon is the expert, paid by the team for their decades of training and experience.
In signing a multimillion dollar contract to provide a service, he is bound to abide be the fine details of the contracts, which include the necessity for the team to be intimately involved in these decisions.
That’s the logic. Opinions and feels are on the side of the lawyers in this case…and apparently you too? |

I look at this as a business transaction, you can't give up your best asset for less than market value, however that assets agent is making it worse for you to get a full return. He signed a contract and is under it for 5 more seasons. If you want to get moved you better at least play ball in the public eye (which they are not doing) - Stripes77

We can all post constantly that Eichel is worth a Zegras, or Byfield, or Rossi, etc., but if no team will give that up, isn't that an indication that his market value isn't what many think it is?
Further, why is there an assumption that if Eichel is healthy and plays well, that it means his market value goes up?
Isn't there a damn good chance that his market value is what it is due to the very public divorce that's going on where every single person involved in the NHL knows the Sabres are going to trade him?
The better time to get the best value for Eichel was the offseason before the 20-21 season. The Sabres missed their window. |
