Again, all that means is there is no probable cause. That is a low burden of proof. Police could of arrested him 10 months ago and continued to collect evidence while he was in jail awaiting trial.

You know the liability for a department if they had evidence to arrest on probable cause but allowed a rapist out on the streets so they could collect “more evidence for trial”? Do you know how much money a new victim would get suing that dept for allowing them to walk the street when they should of been in jail?

So you think they just sat on a rape 1st charge (equivalent to a murder) for over a year? . That’s not how investigations work. You don’t wait a year to charge a person on gang rape “to take your time”

They did their investigation and found no probable cause to make an arrest. Never even made it to the DA because there was no charges/crime. Now the DA wants the case to save face and “look into it”. Unless there is new evidence discovered in the last few weeks (it is always a possibility) or the police dept was involved in a cover up (even more unlikely) this case is dead. Hence just a civil case at this point

Come on, there Rapists on the street right now waiting to be charged because evidence is still being collected or hasn't gone through labs yet. And there's just as many lawsuits for false arrests. With everything going on with the Police right now, they could have just wanted to do there due diligence. And even if he wasn't involved in the gang-rape if he new it was happening and closed a blind-eye to it, he should be charged anyway.
