I don't know if you have that over there where you live Pete.

let say you have a 1 bedroom apartment you rent, oh let say 1000$ per month. you're the owner. I sign a lease with you for 12 months, because, well I'm a good guy and you like me. obviously.
after 6 months I decide to leave and return to Montreal, and instead of paying you the last 6 months, I sell the lease to one of my friend. he'll take over the rent. you as the owner do not have a word to say, you cannot refuse my friend. he could be a drog dealer, an electric guitar player... whatever, you don't have a say in this. and not only will my friend stay there for the next 6 months, but you must keep him for the following years, you're stuck with him like you would be with me.

does that make any sense to you? well here that's the law. and that's what she wants to change. and she has my vote.

No, that’s (frank)ed.

I have a commercial lease with a tenant and to compare it to your story.

There’s a clause that says he can’t sub-lease (lease to someone else) without my approval.

If I do not approve, you’d only have to pay me the remaining 50% of the lease (if you still want out).

If I approve, life goes on, if I don’t get written notice to renew 90 days prior to the end of the lease, out the door I can send him.

Obviously if its a good tenant they’re would be more leniency..

No, that’s (frank)ed.

well here it's perfectly legal, the landlord doesn't have a say in this.
so yeah, the lady was saying, if you think your lease is too high, buy a house. you cannot sell a lease that doesn't belong to you in the first place. not very politically correct but still true imho.
anyway, I hope she succeeds.

so yeah, the lady was saying, if you think your lease is too high, buy a house. you cannot sell a lease that doesn't belong to you in the first place. not very politically correct but still true imho.

that part I don't mind if certain changes are applied, but it isn't like owners don't already have rights protecting them, and it isn't like tenants hold all the power.

she's a real estate investor herself and I have no trust in what she says and how she presents her ideas.

yeah, she's new in politics and was not well advised, rookie mistake.
but she is still right. not saying some owners (big ones) do not do bad things, of course they do, but for small owners like me she is absolutely right. tenants have a lot more power than I do. no even close. no wonder many decide to stop renting and keep their apartments empty.

exact, you as the owner cannot refuse a sublease. people do that to avoid the owner to raise the rent for the next tenant. ok, but there's other ways to prevent that than stripping me from my property! lol

Oh well that is different there.

Commercial and residential are about the same here, my son signed one in edm when he went to school and he could not sublease without consent.

Hell he had a different lease for his parking spot under the building with the same owner.

I still haven’t figured that one out..

A lease you are bound to until the lease is over, even if you allow a sublease, when that lease time frame is over, it’s over.

yeah, same here. I advise my tenant in March that the rent will be raised by 20$ starting July 1st. he has a month to accept (and stay another year) or decline and move out on June 30th.
but at any time he can sublease his rent, without my approval, and I'm stuck with the new tenant that obviously I did not choose.
