Were any of you aware that the NBA puts out a report on the officiating for the last two minutes of any game where the score was within 3 points during that 2 minutes?
And they admit when they frank up?

Again the CBA created a system that allowed teams to offer guys 15 year contracts that paid them top dollar in the first 8 years and then $1m for the next 7 well after the expected age of retirement. It was a clear and intentional violation of the spirit of the CBA.
Note one important factor: The CBA is a contract, so the spirit of the contract has meaning - which does differentiate it from a law (which is sort of the ground we arguing on here) because laws aren't really intended to exist with the idea of "against the spirit of the law".
As a result of the violation the NHL did impose penalties against some teams. They mostly backed down on them or excused a few - but the point remained that the few they didn't like seemingly were punished for it.
I guess in some ways that just goes back to something we have all complained about with the NHL - whether it's rules, governance, on-ice officiating, or off-ice safety punishment - there is no consistency nor enforcement of it in that league. If they were truly consistent attempts to circumvent the cap would result in a punishment. |

Every team in the league work with the exact same CBA. If the Leafs won the cup while taking advantages of ANY loophole, I don't think any of us would be crying foul. We would rightly point out that every other team in the league can do the same. |
