Here's the key part - it is circumvention and everyone knows it. Just like Kucherov was. If a player is healthy enough to play at the end of the regular season and were left on LTIR deliberately because the team couldn't afford him in the regular season - that is circumvention. They have a hard cap. If they wanted a soft cap there are a lot of very, very wealthy teams who would love that - but it would just cause the same problems with the dumb GMs on the poor teams again.

It's only legal because the NHL isn't bothering to do an investigation. Like the murder of a hobo in the slums. It's illegal but no one is ever going to get charged because they're not really going to look too hard.

The league investigated Kucherov. There’s not much an investigation can do except review the medical records. Any docs hired by the league aren’t going to refute what the top hip surgeon in the country says, especially when he’s the team surgeon of an opposing team

It’s fine to argue that the rule is dumb. It’s silly to argue that it’s cheating when a team is abiding by a dumb rule.

Not sure how many people are saying its cheating.

If anything people use the words "cheating" when its the leafs but thats more the anti leaf fans who need to say it for their well being.

Bizonette is saying he heard its head related for nylander. He got hit in game 81. Then migraines and throwing up happened. If true then I have no idea why he played game 82. It also explains why he was dog crap in game 82 too

I'm pretty certain - as are you - that the league "investigated" Kucherov. If Kucherov was healthy enough be to practicing with the team at an elite pace right before the playoffs? And then how did he do in those playoffs?

You're right that you can find any doctor - including one of the most respected surgeons - to back the player. The player should be healthy enough to play in 4-6 months. If he felt he was ready in 7 months, the surgeon is going to back the patient with or without proof. I think it was about 7 months from the date of surgery to the start of the playoffs (I think it was in late October or November if memory serves, and the playoffs started in May, I think.

The bottom line is that when the Kucherov situation happened the NHL proved it's a paper tiger - either unwilling to or powerless to do anything.

If you don't mind me being picky, they aren't so much abiding by a dumb rule inasmuch as they exploiting a loophole.

That would be all well and good except that the league turned around and punished a select few teams for exploiting the loophole with regards to backdiving contracts.

Abiding by a dumb rule is accepting that you have to go the penalty box for a puck over the glass. Exploiting a loophole is what smart criminals do.

My brother-in-law was team surgeon for the Oilers. He said that he would provide advice to the player and the team about the player’s recovery. He might say that a player wasn’t ready to return but he’d never say that a player could definitely return. This was in the pre- cap era.

The issue is more that the CBA doesn’t really give the league any real power because the owners didn’t care about this issue when they negotiated. They wanted the 50-50 split and dealt with cap recapture.
