It's a penalty by the rulebook - but it's also strange. Most of my life I've watched "in the vicinity of the puck" hits be allowed - even after the massive crackdown in 2005. So if a guy is reaching for, but hasn't touched the puck, or if a guy has the puck through their feet - but didn't touch it - or if a guy fans and misses a pass - those have _always_ been guys eligible to be hit.

I would imagine - and I happen to agree - that the hitter couldn't reasonably be expected to know that the player would fail to touch the puck. So in this case or in the case of Guentzel, you could argue the player is maybe just too far away to reasonably be expected to touch the puck? I don't know, but I've felt that a few penalties I've seen early this year are unusual to me.
