(although that rule was not applied last season when Zac Rinaldo delivered a late and high hit that concussed Sean Couturier with less than 1/10th of a second left in the period and the puck a good 15 feet away by the time of impact).
They should be able to use this precedent in an appeal to the commissioner, and then to a neutral arbitrator if the suspension is 6 games or more. So I think they'll make the suspension 5 games to prevent Gudas being able to do that, because putting their absurdly inconsistent record under indepedent scrutiny would be very bad for the league.

Can a Player who receives Supplemental Discipline appeal the Department's decision?
Yes. Players may appeal all on-ice discipline to the Commissioner, provided written notice of the appeal is provided within 48 hours. The Commissioner will endeavor to hear all appeals on an expedited basis and will determine whether the decision was supported by clear and convincing evidence. A subsequent appeal right to a neutral arbitrator will be available for suspensions of six (6) or more games. |

As soon as McKenzie, Dreger & Shannon started tweeting about DoPS looking at Gudas, it was a clear sign he was going to get hit hard. I don't think the hit he's going to get dinged for was worth a suspension, but obviously they feel differently.
It does seem to me that DoPS is starting to listen to their critics when determining justice a bit. If a guy has a hit that raises the ire of some media and fans, it seems that there's far more scrutiny on a subsequent hit. Look at Schenn's suspension. His hit on Oshie didn't seem as bad to me as hits he threw previously, and also it seemed that after the public outcry from folks like Trotz and some of the media, Schenn got held to a different standard for the Oshie hit.
Maybe it's an unintentional bias on my part, but that's the perception I have from it.
Anyhow, it seems to me that based on Manning's health(and he's practicing this morning without a no contact jersey, so seemingly healthy) they're going to bring up either Brennan on Morin while Gudas is out. I think if there's any question of Manning's health it'll be Morin. If Manning is fully healthy and good to go, they may lean toward Brennan-the idea being it's better to sit a veteran, rather than a kid.

Great story on the building of the expansion Flyers.
Gudas is toast. He's getting 5-6 I think and will be on the league radar for the next 18 months where anything even remotely questionable gets 10 or more. He could even have just made himself the expansion exposed guy because how toxic his rep is getting.
Allentown looks to be a definite need for a road trip for a game this season they should be fun to watch. |

The cozy relationship some of the the Toronto-based media have with DPS is pretty shady. They seem afraid to go after them for fear of losing their sources, and prefer to act as PR when there's a player DPS wants to make an example of, no matter how much it deviates from their previous decisions.
For example, Schenn got 3 games for a nothing hit on Oshie. TJ Barrie got 3 games for a leaping headshot that knocked Despres out for three months. |

Yeah, I should have used the Barrie hit as a comp for Schenn. That's exactly what I was thinking of while I was writing my post. |

Also, if Provorov makes the team I forsee some of his untimely errors biting the team on the ass. He's still got a lot to learn, and it will take time, and mistakes are expected, but some of his have been doozies. |

Brandon Manning is on the ice this morning, normal black defenseman jersey so no non-contact.

Yeah, if he makes the team it is going to be hard to watch a Flyers defenseman make mistakes |

I'm okay with that. If he makes the Flyers this season, he's going to make some bad mistakes. If he doesn't make the NHL until next season, he's going to make some bad mistakes. If people see this as a sort of transitional year, which I do, better to make (and hopefully learn from) them this year. Prime example was the giveaway late to Boston. Hopefully he now knows that you have to bear down 100% of the time and can never let up at this level. |

I agree. I suppose it will depend on how egregious they are and how many there are whether he stays around after nine games (assuming he makes the roster).
That giveaway against Boston was brutal. It looked like he never even considered the possibility that someone could be behind him. |
