"He claimed to be injured when we traded for him, so we had him see the doctors," Briere said. "They found an injury, so now he's going to be rehabbing. You can't send down a player who's injured, so he's going to be doing rehab until ... we don't know when. That's about all I can say at this time, or all that I have. So, he's back on our roster doing rehab and trying to get better."

Unless they are going to sue their doctors for malpractice this sounds like an uphill battle. Also the fact they didn't contest the trade when they discovered the injury might work against them. They never cared about the player or his status and they only do now because they can't buy him out.

Anyway, if he contests it should be entertaining.

Another flyers PR black eye. Briere has his work cut out for him. Doesn’t matter who’s right or wrong.
It makes it look like they aren’t doing their due diligence.

It’s tough to do but you have to separate all these different Flyers situations….from Guathier to Kosolov to RYJO ….one thing appears to be true….the Flyers alway seem to make news…although not always is that a good thing.

They're going to contest it,without question. Can the Flyers prove the "material breach of contract" they are asserting is the question.

I would assume something changed in the last month or so. Something that changed and I would expect the Flyers think they have a strong case or why bother ?

The only thing i can think of, since the Flyers doctors confirmed the injury, is that they are going to claim the injury wasn't career threatening and has healed well enough for him to play but that he milked it.

If he actually has surgery scheduled that means multiple doctors have confirmed the severity of the injury. I can't imagine what the Flyers basis is if it's not the injury itself.

We are talking about the least experienced FO in the league who are learning on the job and have already experienced multiple media crises.

I can't imagine that they won't look foolish but no, i don't have any inside knowledge and may be proven wrong.

Overhardt is definately off DB and Jonesy's Christmas list though. With RyJo and Kolo so much for the next month being boring.

We already know they didn't because they never cared about the player. He was never going to play for the Flyers. Briere admitted it and half the board gave him a pass for getting the 1st round pick.

One would think a professional hockey team wouldn't trade for a player without due diligence but here we are. Didn't even blink when they found out he had an injury after the trade while trying to put him on waivers.

So we'll see, you are probably correct.

To be fair, with the player playing every game including the most recent game before the trade. Why would you consider that he was injured? Why wouldn't you be able to waive a player who has been playing?

Is there evidence from Colorado that he was playing injured? Because plenty of players will play through injuries on a contender, that they would absolutely shut down their season for and get surgery on with a non-contender.

Could be either an unreasonable delay in getting the surgery or perhaps he got caught performing some type of physical activity that would call into question the severity of the injury.

So little is known about the injury. It could be like the Eichel situation. Something like no consensus on the surgery or Ryjo doesn’t want what they recommend.

Eichel wasn't playing. We knew Eichel needed surgery. The team has control over the players medical treatment. There has been nothing out of the Flyers camp on Johansson needing surgery.

Flyers will use the cap space if/when the money officially comes off.

That's what his agent said now. Why wasn't that said back in March when the Flyers acquired him? Trying to talk through it to figure out what is going on. Doesn't add up.

You do due diligence so that there are no surprises. 99% of the time nothing turns up, you do it for the 1%. Nobody questioned the Flyers ability to put a healthy player on waivers.

Maybe the Flyers pulled a Gold Standard trade and there's nothing they could've done differently but finding out about an injury post trade and to have your doctors verify it is a bad look, period. Not caring about said injury when they found out makes them look indifferent to the injury. They could've dealt with it at the time and voided the trade.

That's what makes this "material breach" so interesting. It feels like they are trying to have their cake and eat it to. Their choices were to void the trade and lose the pick or keep the player and keep the pick. They are now trying door #3. Keep the pick and lose the player.
