I agree with this as well and also agree with those that say the NHL has shown weakness/desperation by offering hand-over-fist offer after offer after offer with better and better deals.
This is where my suspicion kicks in and I start to see the NHL strategy of appearing to bargain in good faith, an argument that may one day soon be made in front of a judge and where the league is likely to claim that the NHLPA has not made an honest attempt at a deal. - Senators2112
This is the third time I have posted this regarding good faith bargaining, and if this were presented to a judge then he would rule that NEITHER side has bargained in good faith.
Definition of good faith bargaining from uslegal.com
Good-faith bargaining generally refers to the duty of the parties to meet and negotiate at reasonable times with willingness to reach agreement on matters within the scope of representation; however, neither party is required to make a concession or agree to any proposal.
Good faith bargaining requires employers and unions involved in collective bargaining to:
■ use their best endeavours to agree to an effective bargaining process
■ meet and consider and respond to proposals made by each other
■ respect the role of the other's representative by not seeking to bargain directly with those for whom the representative acts
■ not do anything to undermine the bargaining process or the authority of the other's representative.

I've got two theories, and I'm not sure either of them are even close to be being right:
1) Either Fehr is smart and knows that the best deal he can get will come at the 11th hour, so he's waiting until the absolute last minute to do so. He really cares about representing the players the best way he thinks he can and getting the game back on the ice.
2) He doesn't give a poop about any of this, and wants to be known as the guy who changed baseball and hockey, no matter the cost. He'll push this through the courts as long as it takes for the owners to crumble and give in to all the players demands.. maybe even possibly go after the salary cap.
Either one at this point is just as likely to me. The PA's response to this offer might shine light on which one. |

OK well I will be the first to admit I am not a labor lawyer, and almost nobody will claim to know WTF would happen if the union really does decertify and pursue individual lawsuits against the league...
What I am getting at is, and I've supported the owners 100% through all of this, is that unless they just madly love hockey so damn much (or owner mandated to save the season) that they are giving and giving and giving in these proposals, then I try and look a little deeper to understand their strategy in all this if poop hits the fan and this all falls apart.
Say what you will about the ownership side of the game, but very few would call them stupid. Something is up.

Well the 3pm NHLPA conference call should be wrapped up by now. Wait for players + agents spewing their mouths off, should provide a general indication on how this will play out over the next few days. |

I think it will be number 1 however I don't think he gives a damn about the majority of the membership, but only really cares about the top 10% of the players.
If it's number 2, he'll be fired or slapped into capitulation. Too many players will be hurt in that process.
Seems to me the NHL has been negotiating against themselves through most of this. Not sure how you win a long anti-trust court battle where only one side (NHL) is offering complete, detailed deals. |
