it's the differnce between Uber and buses/planes/regular taxi - last category are way more heavily regulated on use of recordings (mainly for safety reasons recordings can be used).
people have to understand that when you take an uber, it is not a public service, but a private service - the car being private property of the driver.
state laws differ on this, but in general it makes alot of sense that people can record in their own properties.
As stated in the customer TOS and driver contracts with Uber (the same as any other rideshare), Uber can AND WILL collect any and all available data from the app and any device systems allowed to the app as it is installed on your phone or tablet.
That is very ambiguous, but that part of TOS might cover the recording and use of recordings as well.
Last point: very likely that the uber car had a sign/sticker in it saying that passengers were being recorded (and that the footage could be used). Not sure if the driver has to explicitly make passengers aware of the particular sign (don't think so). |

Babcock is showcasing Marner for a trade.. Plays on the PP, and the PK. Plays on the top line with Zach Hyman.
It's evident that Marner is gonna be dealt, probably for a package of picks and prospects. That will really set us up nicely in 5 years. |

This is not correct either.
If you are indeed in a public place then anyone can film you and do whatever they like with the footage - you have no right to it, unless they do something illegal with it.
The driver had the right to film the contents of his car for security purposes, and release said video if (for example) an occupant of the car willfully damaged his vehicle. However, he would only be able to release the video to the police or perhaps his insurance company.
There was intent to injure the reputations of the occupants when the driver released the video on Twitter, and is legally liable for that. I'm sure there are several clauses in Uber's contract that cover this sort of behaviour, which is why they have grounds to terminate his contract. The players in the car could sue the driver for damages, but it's unlikely that they'll do that (see: Streisand Effect). |

You are flat out wrong here.
Ontario recording laws
Generally, it is illegal to secretly record oral communications between two or more people unless you have the consent of at least one of the individuals involved. For pure video recording with no sound, however, you may have greater freedom to secretly tape people.

I have never been in an Uber where there was a sticker anywhere saying that I was being recorded for any reason.
The issue is that the driver intended to injure the reputation of the players when he released the video, and that's where he is legally liable. This is where Uber has grounds to terminate his contract and is likely to use it. |
