That sir is very true. If they CHOOSE that. She could have also chose another path.

Interesting that she is reported to want nothing to do with this anymore isn’t it. Kinda like she moved on?

She’s a young women who probably wants to live her life with out being known for something like this. Hopefully she’s doing just that.

Our failed education system on display here folks.
- Tomahawk

Yes you were failed obviously. Or YOU failed.

There are different levels that need to be meet to have a criminal charge meet and prosecuted.

For example woman agrees to sex but not to certain things DURING sex. And man does those things. This isn’t rape. And won’t be charged rape in whatever degree.

It would be charged as either sexual abuse or sexual assault depending on what was done and what degree the criteria are meet.

This goes for any crime. There are levels within a crime category and different degrees still within.

Usually with the Flyers it’s always the best outcome possible. Don’t be a Debbie Downer.

Actually he is correct. They are two distinctly different things in the eyes of the law. That doesn't lessen or diminish either, it is just a fact.

Colloquially the umbrella of sexual assault includes rape.

Legally, it depends on the jurisdiction.

In Ontario the legal definition of SA includes rape (and what happened to the victim would be consired rape in most if not all other jurisdictions).

Ah, the good ol' days. We were debating on whether we should buy or sell at the deadline. Which team we matched up against for the first round.

I think police are supposed to take into account the victims wishes in situations like this. If she indeed wanted to move on etc, then she maybe asked that they wouldn’t be charged. It appears she may have changed her mind which is her decision. When they are charged and this goes to trial, unfortunately the lawyers will want to cross examine her etc which can be a re victimization. Regardless, the police must have a solid case here. Just shocking. I wonder who the four other players are?

I will concede I don’t know Canadian law. I can assure in USA law sexual assault does not necessarily mean rape. And someone can be charged with 1 while not meeting criteria to be charged with the other.

Maybe Canadian law is different idk. Maybe Canada law doesn’t have that distinction. I do speak from USA law point of view. I would find it strange tho that Canada would not allow for distinction tho. As there are obvious and clear sets of circumstances involving any type of sexual assault

Omg. Right. Haha it’s normally the worst outcome not even imaginable. That’s part of why I expect him to be charged.

Yes 100% it is….
If “the victim” DOESNT want charges filed (she settled the matter to HER satisfaction) as SHE saw fit. That is the ONLY opinion in the matter that actually matters.

The police have no business laying charges if the victim doesn’t want it.

Yes they do if they uncovered more evidence. Cold cases are reopened all the time.

they're already screwed this season

Torts has had this game with their foot on the gas pedal all season while teams have been for the most part coasting against us

now we're seeing what teams like colorado and tampa can do against us when they try

I don't even know why you and MB brought the legal angle up. Feanor was clearly using 'rape' in the colloquial sense.

And if you know what's been alleged it clearly crosses the threshold for rape. She was penetrated without consent by multiple players FOR HOURS.

Yes they would take her wishes into consideration. But that does not mean she makes the final decision. It has become such a big story that I think the police have no other route to take but to lay charges and let the courts figure it out. Factor in its to do with professional athletes I never did think this would go away.
